Please read the following Terms of Service carefully before you agree to dog waste

removal services from Scoop 440.

Scoop 440 is an independently owned and operated business (“us,” “we”

or “our”) that provides pet-waste removal services to residences, businesses and

commercial properties, you agree to the following terms of service (“Terms”) that govern

the sales and services provided by us (“Services”). By accepting the Services you hire

us for, you are bound to these Terms.

The customer understands our ability to provide the Services can be dependent on

weather, condition of grass height, access to your yard which is your own responsibility,

and other unknown outside influences.

DOG WASTE REMOVAL SERVICE

Scoop 440 offers residential and commercial pet waste removal services.

These services include One Time Clean, Weekly Cleaning, Every Other Week Cleaning, Twice a Week, and Seasonal Cleaning. All pricing is based on an area size of an 1/4th of an acre.

Larger areas will have an additional charge.

ACCESSING YOUR YARD

The Customer understands that if Scoop 440 can’t access the area

needing cleaning due to locked/blocked/frozen gates or dogs in the yard; the scoop will

be skipped and charges will still apply. Scoop 440 suggests adding gate

combinations or lock keys to your file to avoid locked gates.

WEATHER

Scoop 440 will work through the rain and cold as long as we can safely

do so. The customer understands we cannot work through severe thunderstorms, high

winds, extreme high or low temperatures, flooding or an accumulation of snow.

Scoop 440 is a MONTHLY subscription service. We do not offer refunds

for missed weeks due to weather. Therefore in these cases, we will skip service for that

week, and see you the following week. A refund will not be issued as we still have to

pick up all of the poop that would have been scooped the prior week. If you need the

area cleaned before your next scheduled service, please call us and we will do our best

to accommodate, but cannot guarantee it. Additionally, we do not want to tear up your

yard in any way. If it is very muddy, we may skip your yard and wait until the next

scheduled visit when things have dried out.

REFUNDS

If the yard is cleaned while we missed your service day for the week, we will credit your account for next month or issue a refund for the weekly amount accordingly.

HOLIDAYS

Scoop 440 does not provide services on the following holidays: Memorial Day, 4th of July, Labor Day, Thanksgiving Day, Christmas Day and New Year’s Day. If your pick up day falls on one of these days, we will try to accommodate during that week or pick up the following week. There are no refunds for a missed pick up. We still have to pick up all of the poop from the week prior. If the yard is cleaned while we missed your service day, we will credit your account for next month accordingly.

BILLING

Scoop 440 pre bills monthly or one time billing for our service. Your account will be charged

on the 1st of the month for service. If your card is declined, we will discontinue service

immediately until the issue has been resolved. If more than 30 days have passed since

your last clean up, a first time clean up fee will be applied. We will only pause service

for periods of 30 days. If service does not resume after the 30 day period you will be

removed from the schedule. One Time Cleanings will be billed after the service has

been completed. Payment is due within 24 hours. If payment becomes more that 30

days late Scoop 440 will turn your account over to collections.

PRICING

Each customer will receive a personalized quote for weekly service, which will be provided in writing (e.g., via email, text message, or invoice) prior to the start of service. We reserve the right to adjust pricing at our discretion, including but not limited to changes in the above factors (e.g., yard expansion, additional dogs, amount of waste or seasonal shifts), operational costs, or market conditions. Customers will be notified of any price changes in advance where feasible, though adjustments may take effect immediately for new service requests or upon renewal of existing service agreements. All prices are exclusive of applicable taxes or fees unless otherwise stated.

LEAVES, DEBRIS AND TALL GRASS

We will always do our best to clean your yard the best that we can. We understand that

maintaining your yard is a lot of work and it may not always be in the best shape. The

customer understands that it can be very difficult to find dog poop in tall grass or in a

yard full of leaves/snow or other debris. If your grass is tall when we come, there may be

some dog waste that is missed. We will be back on our next scheduled visit and will get

anything that was missed if yard maintenance is complete. If you find an excessive

INJURY/DOG BITES

Homeowner/Customer is responsible for any injury that occurs while at their property. All dogs should be kept inside during service to prevent encounters and the chance of injury.

ADDITIONAL FEES

The following are items we charge extra for:

Late Fees: Over 30 days is 100% of past due amount.

DENIAL OF SERVICE:

We reserve the right to deny service to any individual or entity at our discretion.

We may collect personal information from you on our Sites or through any other digital

or personal communication with you. Information collected by us is voluntarily provided

by you and may include information such as your name, email address, phone number,

and physical address. Our Sites may collect general information about the service you

are requesting such as the type of property and area needing service, the type and

number of pets you have, and general information about your pet’s behavior.

We collect information about you in order to provide you with our services. We use

personal information about our users for a variety of purposes related to our business,

your information is for Scoop 440 use only. We will never sell your

information or send it to third parties.

We may provide user information to third-party service providers or vendors for

purposes of, including without limitation, processing your payments or sending

information to you, data tracking, maintenance or development of our System. We may

also share your personal information in connection with law enforcement requests or in

response to investigations, subpoenas, court orders, or other legal processes to

establish or exercise our legal rights or defend against legal claims or as otherwise

required by law.

REVISIONS

Scoop 440 provides the above Services to you subject to the Terms,

which may be amended from time to time without notice to you. Amendments will be

effective upon our posting of such updated Terms to our website. We recommend you

visit the site (Scoop440.com/terms) to review any changes in our practices. Your continued use of our

Services shall constitute acceptance to any changes to the Terms. Some of the

provisions contained in these terms of use may also be superseded by provisions or

notices published elsewhere on our site.

SHUT DOWN

We reserve the right to shut down operations fully between the week of Christmas and the week of New Years Day. You will be billed at your normal Monthly rate unless you scoop your yard fully during our shut down.
